Art. 1 Introductory information

  1. These Terms and Conditions are the regulations for the provision of services via the website: www.galeriawprzyziemiu.pl
    (hereinafter referred to as the ‘Website’.
  2. The owner and entity providing services through the Website is: Aneta Sieńczak, an entrepreneur entered in the Central Register
    and Information on Economic Activity (CEIDG) under the name: Galeria Sztuki ‘W Przyziemiu’; Aneta Sieńczak with its registered
    office in Kraków (31-032), ul. . Starowiślna 36, ​​NIP 6442911629, REGON 389435050 (hereinafter referred to as the ‘Service
    Provider’.

  4. These regulations were adopted on October 6, 2022
  5. The Service Provider reserves the right to amend the Terms and Conditions.

Art. 2 Types and scope of services provided

  1. The Website contains basic information about the business conducted by the Service Provider and an online store with
    contemporary artworks
  2. Through the Website, the Service Provider provides paid and free services:
    a. as part of the online store – sale of products
    b. subscription of the newsletter with commercial information (promotions, special offers)
  3. Paid services are marked in such a way that there is no doubt that using them entails an obligation to pay

Art. 3 Technical conditions for using the services

  1. In order to use the Website properly, you need:
    a. device (computer, tablet, smartphone) with an internet connection,
    b. web browser,
    c. full legal capacity to make purchases on the Website,
    d. e-mail address in order to make purchases on the Website or subscribe to the newsletter.
  2. It is forbidden to publish any illegal content on the Website.

Art. 4 Sale of products

  1. Placing orders:
    a. Successful placing of an order requires providing the data specified in the order form. The data should be true and up-to-
    date.
    b. The sales contract is concluded after you provide the mandatory data, click the ‘Place order’ option, pay the price and e-
    mail confirmation of the order sent by the Service Provider.
    c. The Service Provider will execute the order after you have made the payment and your order is confirmed. The payment
    deadline is 7 days.
    d. Orders are processed within 3 to 7 days from the date of confirmation that the order was accepted for execution. Fulfillment
    is understood as completing and shipping the order. If the order cannot be processed within this period, you will receive
    information from the Service Provider.
  2. Payments
    a. The Service Provider enables payment via internet payment operators or by bank transfer
    b. Payment is made when the funds are credited to the Service Provider's account or the funds are credited to the payment
  3. Delivery / Receipt of goods
    a. The Service Provider delivers the goods via a courier company or Polish Post
    b. The costs of delivery are specified by the Service Provider on the website so that they can be known before placing the
    order
    c. In the event of any irregularities in the condition of the shipped parcel, in particular its external damage, you should report
    this fact to the courier and write a report with him including this information. Remember that failure to comply with the above
    obligation may result in refusal to recognize your claim
    d. It is also possible to collect the order in person at the seat of the Service Provider, in Krakow (31-032) at ul. Starowiślna 36
  4. Guarantee: The Service Provider grants the Consumers a quality guarantee to the same extent as he is liable under the warranty
    for physical defects of the goods, in accordance with the provisions of the Civil Code.
  5. Other information
    a. In case of doubt, the prices given in the store are considered gross prices.
    b. The Service Provider reserves the right to refuse the order if, in particular: (a) you have provided false data, preventing the
    delivery of the parcel (b) you have not picked up the parcel twice (c) you have not paid for the order on time.

Art. 5 Consumer Rights

  1. Every person who purchases products or services as a Consumer, within the meaning of the Civil Code, has the right to
    withdraw from the contract without giving any reason.
  2. In order to exercise the right to withdraw from the contract without giving any reason, you are obliged to submit a declaration of
    will in this regard. All you need to do is send us an e-mail or a handwritten letter stating your data (name, surname, address,
    possibly telephone number or e-mail address), information about the purchased product or service with a declaration that you
    withdraw from the contract.
  3. The 14-day period is considered met if you send us an e-mail or letter before the expiry of this period.
  4. In the event of withdrawal from a distance contract, the contract is considered void and for this reason we are obliged to return
    the payments made by you to you, and you are obliged to return the purchased products.
  5. Not later than within 14 days from the date of receipt of the declaration of withdrawal from the contract, we will refund all
    payments made, including the costs of delivering the product (if you have incurred such costs). Payment may be withheld by us
    until we have received the products back from you or you have provided proof that you have sent them back. We will refund your
    payments to you using the same method you have used for payment, unless you request that we refund your funds otherwise.
  6. Products should be returned no later than 14 days from the date on which you withdraw the contract. To meet the deadline, it is
    enough to return the items before its expiry. If you have chosen a delivery method other than the cheapest standard delivery
    method offered by us, we will not be obliged to refund the additional costs you have incurred.
  7. In the event of withdrawal from the contract, you are responsible for reducing the value of the returned products as a result of
    using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Art. 6 Newsletter

  1. The service in the form of subscription to the newsletter is free. It consists in sending by the Service Provider commercial
    information about promotions and special offers of the Service Provider. By subscribing to the newsletter, you give consent to
    the Service Provider for sending commercial information to the e-mail address provided by you.
  2. You can unsubscribe from the newsletter at any time by using the unsubscribe option provided in the newsletter or by contacting
    the Service Provider.

Art. 7 Reporting and processing of complaints

  1. Each person using the Website has the right to make a complaint.
  2. All complaints, comments and reservations can be sent to the following address: info@galeriawprzyziemiu.pl
  3. The complaint should include:
    a. your name and e-mail address,
    b. accurate description and reason for the complaint,
    c. your requests, proposals and conclusions.
  4. The complaint procedure takes 14 days.
  5. We respond to the complaint by e-mail.

Art. 8 Dispute resolution

  1. By accepting these Terms and Conditions, you agree that in the event of a dispute, we will try to resolve it jointly and amicably.
    The time for negotiations will be 3 months from the date of submitting the claims by the Service Provider or by you. If we do not
    find a solution to end of the dispute within the specified period, we will be able to submit our claims to the common court.
  2. In the case of providing services to a Consumer residing in a country other than Poland, we agree that the case will be
    considered according to Polish law. This agreement does not deprive you of the protection afforded to you under provisions that
    cannot be derogated by contract and by law.

Art. 9 Protection of personal data

  1. The Service Provider is the data controller within the meaning of the provisions on the protection of personal data (GDPR and
